Justice Mojisola Dada of the special offences court sitting in Lagos, on Thursday declared the Chairman of Innoson Motors Nigeria Ltd, Innocent Chukwuma wanted over his failure to make an appearance in court for his arraignment for the fifth time.

Chukwuma, alias Innoson is standing trial in a matter between his company and the Economic and Financial Crimes Commission (EFCC).

Justice Dada had declared the automobile boss wanted, granting the request of Mr Anselem Ozioko, the lead prosecuting counsel of the EFCC.

The News Agency of Nigeria (NAN) reports that Innoson had previously failed to make an appearance in court for his arraignment on Jan. 17, Feb. 9, March 14 and April 25.

His failure to appear before the court for five consecutive times informed the issuance of bench warrant.

During the proceedings of March 14, it was revealed that Innoson had petitioned the National Judicial Council (NJC) over Justice Mojisola Dada, the judge trying the case.

Ozioko in his submission seeking the declaration of Innoson wanted said: “This appears to be the fifth time this matter is coming up before your Lordship for arraignment.

“The learned Senior Advocate of Nigeria representing the second defendant (Innoson) is still insisting on taking his application without ensuring the defendant is physically present in court.

“The question is, where is the second defendant? Is he too big for the court? Is he too big for the Federal Republic of Nigeria? Is he too big because he has money? Where is he?

“What my learned friends, the defence counsel are doing is contemptuous.

“We shall be applying for an order to declare the second defendant wanted.”

Acceding to Ozioko’s request, Justice Dada said, “The second defendant is hereby declared wanted and the case adjourned until June 22 for possible arraignment.”

Earlier, during the proceedings, Ozioko had informed the court that the anti-graft agency will also be taking some steps to ensure Innoson’s attendance in court on the next adjourned date.

Counsel to Innoson, Mr George Uwechue (SAN) had requested that the court hear his application despite Justice Dada’s declaration that no application will be heard until Innoson is physically present in court.

“At the last hearing, the court maintained its position that it will not take its pending application unless the first defendant is arraigned.

“We were about to cite our position regarding the court’s declaration but we were interrupted by the prosecuting counsel and that interruption led to today’s proceedings.

“Whatever we did that day, we sincerely apologize; we urge this court to allow us to continue our presentation.’’

Prof. J. N Mbadugha, counsel to Innoson Motors Nigeria Ltd, in his submission told the court that he had an application challenging the jurisdiction of the court.

Mbadugha informed the court that he had made an appeal at the Court of Appeal over the case.

Justice Dada however maintained her position that the applications of the defence will not be heard until Innoson is physically present in court.

NAN reports that Chukwuma and his company, Innoson Motors Nigeria Ltd, are to be arraigned on a four-count charge of conspiracy to obtain property by false pretences, obtaining property by false pretences, stealing and forgery.

According to the charge sheet, the defendants committed the offences between 2009 and July 2011 in Lagos.

The EFCC alleged that the defendants with intent to defraud; conspired to obtain by false pretences containers of motorcycle, spare parts and raw materials, property of Guaranty Trust Bank (GTB) from Mitsui OSK Lines Ltd, Apapa, Lagos.

They are alleged to have fraudulently induced staff of Mitsui OSK and Maersk Line to deliver to them via their clearing agents the goods which were imported from China in the name of GTB by falsely pretending that they were authorised by the bank to clear the goods.

The prosecution claimed that the defendants in order to facilitate the fraud forged a bill of lading numbered 598286020 of Maersk Line Limited and 11007950841 of Mutsui O.S.K Lines by knowingly putting a false GTB stamp and signature of the bank staff.

The alleged forgery was in order that the forged documents be used or acted upon as genuine to the prejudice of any person within Lagos or elsewhere.

The offences contravened Sections 1(1)(b), 1(3), and 8(a) of the Advanced Fee Fraud and Other Related Offences Act 2016 and Sections 309(9), 388, 465 and 467(1)(j) of the Criminal Code, Laws of Lagos State 2003

Operatives of the Inspector-General of Police Intelligence Response Team have arrested one of the four robbery suspects declared wanted for attacks on banks in Offa, Kwara State.

The suspect, Michael Adikwu, an ex-policeman, was said to have been dismissed in 2012 by the Kwara State Police Command for allegedly aiding the escape of some robbery suspects.

PUNCH Metro learnt that Adikwu, until his dismissal, was attached to the Special Anti-Robbery Squad of the state command.

Adikwu was said to have been arraigned in court and remanded in a prison, where he spent three years before he found his way out and formed a robbery gang with others.

He was reportedly arrested on Tuesday in a town in Kwara State by the DCP Abba Kyari-led IRT operatives, who acted on a tip-off from members of the public who saw Adikwu’s picture among those declared wanted.

A robbery gang had stormed some banks in Offa on April 5 and killed scores of people, including nine policemen.

They reportedly carted away millions of naira during the operation which lasted for about an hour.

Although the state Commissioner of Police, Ado Lawan, put the number of fatalities at 17, the Operations Commander, Vigilance Group of Nigeria, Offa, Kwara State chapter, Wasiu Adepoju, said his men counted 50 corpses.

Leaked Closed Circuit Television footage of the incident revealed when the robbers blew up a security post of one of the banks as they intermittently brought out bags suspected to be containing money out of the premises.

While about 20 suspects were said to have been arrested, the Kwara State Government placed a bounty of N5m on the other fleeing robbers.

In a statement on Friday, the Force Public Relations Officer, ACP Jimoh Moshood, released the pictures of four members of the gang captured in the CCTV footage and declared them wanted.

Moshood stated that the assailants were being monitored by the International Police and would soon be apprehended.

A senior police officer disclosed to PUNCH Metro on Wednesday that one of the wanted robbers was tracked down on Tuesday.

The source said the arrested suspect, Odikwu, was a police corporal and was dismissed from the Force in 2012 after his alleged involvement in the escape of some robbery suspects.

The source said, “He (Adikwu) was a SARS operative at the Kwara State Police Command. He used to fraternise with robbers. There was a robbery that happened in Kwara State about six years ago. The robbers killed somebody and escaped. The police were able to arrest those robbers.

“He collected money from those robbery suspects and released them. Later, the robbers were rearrested and they confessed that he aided their escape. He was arrested, tried in an orderly room trial and dismissed.

“He was charged to court together with the robbery suspects and was in prison for three years. He and some of the robbers were able to manoeuvre their way out of the prison and formed a robbery gang.”

Another source said a team of detectives got a lead that Adikwu was staying in a hideout in the state and swooped on him.

“The lead was given to the police by an informant. His hideout was cordoned off and he was arrested. He was apprehended by the IRT operatives in a community in Kwara State,” the source added.

The Police Public Relations Officer, Kwara State Command, DSP Ajayi Okasanmi, said arrests had been made, but he had yet to receive information on Adikwu’s arrest.

He said, “What I know is that the IRT team and the command are investigating the matter and have been making arrests. The Force PRO will come out with other information at the right time.”

The FPRO, Moshood, could not be reached for comment as calls to his line rang out.

He had also yet to reply to a text message sent to his telephone as of press time.

The Kogi State Police Command has declared the lawmaker representing the Kogi West Senatorial District, Dino Melaye, wanted.

The lawmaker was declared wanted alongside Mohammed Audu, son of a former governor of the state, Abubakar Audu.

Apart from Melaye, represents Kogi West Senatorial District, 7 other persons, including Mr. Mohammed Audu, were also sent to INTERPOL for “red notice”.

A statement signed by the Commissioner of Police, Kogi State Command, Mr. Ali A. Janga, but sent by the Force Public Relations Oficer, ACP Jimoh Moshood, said the red notice followed the “escape” from detection of the 6 suspects, two of whom the police alleged, had linked Melaye to purported plans to cause unrest in the state.

“The Nigeria Police Force, Kogi State Police Command today 28th March 2018 received a news that six (6) suspected criminal elements namely; Kabiru Seidu a.k.a Osama, Nuhu Salisu a.k.a Small, Aliyu Isa, Adams Suleiman, Emmanuel Audu and Musa Mohammed who were under detention at the ‘A’ Division Lokoja escaped from lawful custody. Four of the suspects were on court remand including two that indicted Senator Dino Melaye and Mohammed Audi”, janga said.

He added thus: “Consequently, all the six suspects, Senator Dino Melaye and Mohammed Audu were sent for watchlisting and red notice by the INTERPOL for immediate arrest anywhere we see them..”

Meanwhile, the police boss said 13 officers, who were on duty when the said disappearance from lawful custody occurred, have been detained for interrogation.

His words: “The Command hereby appealed to the members of the public to assist the Police with useful information on the whereabouts of the suspects by reporting to the nearest Police Station.

“Investigation into the unfortunate incident is ongoing, while the thirteen (13) Police Officers who were on duty when the incident occurred were defaulted and detained for interrogation.

“Members of the public are hereby enjoined to go about their lawful duty as the Command is determined in ensuring adequate security of lives and property in Kogi State.”

The war of words between Melaye and the Kogi State Governor, Alh. Yahaya Bello, has continued, since the parade of the suspects in Lokoja last week.

While Melaye had accused the Governor of being responsible for his ordeal, the latter had denied the claim, even as he asked the lawmaker to face the law.

While this lasted, the Senate at plenary, mandated its Committee on Judiciary and Legal Matters, to investigate the allegation of harassment against Melaye.
