NIGERIA’S antigraft agency, the Economic and Financial Crimes Commission (EFCC), has conformed with the order of Nigeria’s High Court, directing the removal of the name of the Executive Vice Chairman of Aiteo Group, Benedict Peters, from its list of wanted persons.

This action confirms EFCC’s compliance with the judgment handed down in March 2018, by Justice O.A. Musa of the High Court of the Federal Capital Territory. Justice Musa had ordered that Peters’ name be taken down from the anti-graft agency’s website, describing the process leading to his declaration as ‘wanted’ by EFCC as unconstitutional, since it was not initiated or validated by any known law or court order.

Reacting to this development, renowned Constitutional and Human Rights Lawyer, Chief Mike Ozekhome, SAN, said: “We wish to commend the Economic and Financial Crimes Commission (EFCC), under the leadership of Ibrahim Magu, for living up to its commitment to uphold the rule of law and obey the order of a competent court to remove the name of the Mr. Benedict Peters, from its list of wanted individuals. The EFCC has shown a deep regard for the sanctity of the nation’s legal system, and we can confirm that Peters’ name has been cleared. In view of this and based on the fact that the decision by EFCC is premised on a court order, Peters has been legally excluded from the list of wanted persons in Nigeria. He can therefore continue his lawful business and enjoy his constitutionally guaranteed rights.”

The EFCC in March 2017 declared Peters wanted on its website. However, in response to suit, FCT/HC/CV/23/2017, the court reached the incontrovertible conclusion that Peters has never been charged with, nor tried for any criminal offence in any court of law, nor has he ever jumped bail for any offence howsoever in Nigeria and cannot be declared wanted by administrative fiat without any prior order or leave of court. In the proceedings challenging EFCC’s actions, Justice Musa declared that “…the very act of declaring the Applicant (Benedict Peters) a WANTED PERSON on the official website of the 1st Respondent (EFCC) without any prior order or leave of a Court of competent jurisdiction to that effect is unlawful, illegal, wrongful, ultra vires, unconstitutional and constitutes a flagrant violation of the Fundamental rights of the Applicant to personal liberty, private and family life, freedom of movement and Right to not to be subjected to inhuman treatment and degrading treatment as guaranteed under Section 34, 37, 41 and 46 of the constitution of the Federal Republic of Nigeria, 1999 (As amended) and Articles 2, 3(1) & (2), 4, 5, 6, 7, and 12(1) of the African Charter on Human and Peoples’ Rights (Ratification and Enforcement) Act 2004”.

Benedict Peters has recorded successful outcomes in three other cases, including one overturning the forfeiture of his properties which were wrongfully included in a list of properties belonging allegedly belonging to a former minister forfeited by court orders.

International business leader and founder of Aiteo Group, Benedict Peters was awarded Africa’s Oil and Gas Leader of the Year at the Forbes Best of Africa Gala which held at Forbes Headquarters, New York City on September 27, 2018.

The award is an acknowledgement of Peters’ significant contribution to oil and gas development in Africa by visionary leadership, distinguished service and transformational realignment of a sector dominated by International Oil Companies. The Forbes Award also recognised Mr. Peters’ commitment to bettering the lives of people and societies across Africa by philanthropic engagement.

On presenting the award Mike Perlis, CEO and Vice-Chairman of Forbes Media said, “recipients are singled out for their work in bringing prosperity to all 55 countries of the African continent”.

According to the Editor, Emerging Markets for Forbes, Paul H. Trustfull, “Peters’ ascendancy in Africa’s Oil and Gas sector has been exemplary as well as revolutionary. His company, Aiteo, has thrived for about two decades – going from a downstream start-up to becoming a leading integrated energy conglomerate with strategic investments in hydrocarbon (or commodities) exploration and production.”

Peters reinvented himself in times of great personal challenge. He resurrected his identity and reputation while battling injustice. He proves that inspirational leadership in a difficult industry is possible.” Trustfull added.

Dedicating the coveted award to all Aiteo employees worldwide, Benedict Peters said “The acknowledgement by Forbes as Oil and Gas Leader of 2018 is inspiring. It means a lot to me and the entire Aiteo Group. I am delighted that the International community recognises our contribution towards Africa’s self-sufficiency in energy and our aspiration to become a reference point for indigenous capacity in oil and gas. This award motivates us to broaden our vision for the continent, despite all odds, and accelerate her economic transformation. We believe that Africa has what it takes to lead the world and we will continue to push the frontiers of development through our investments in people and technology. The success of our Oil and Gas Upstream subsidiary proves that the future we envision in Africa rests to a large extent in the hands of Africans.”

Mr Peters ventured into the oil and gas sector as an entrepreneur in 1999 and initially traded mainly in the downstream sector.

Aiteo is currently the highest producing indigenous oil E&P company in Nigeria.

In 2015, Benedict Peters consolidated Aiteo’s asset portfolio with a $3 billion acquisition of sub-Saharan Africa’s largest onshore block (OML 29). Subsequently, Aiteo optimised the asset’s yield from 17,000 barrels of oil per day (bopd) to almost 70,000 bopd within the year of the asset’s acquisition. The largest indigenous energy provider currently peaks production at around 100,000 bopd, doubling its initial asset value to $6 billion within three years. The company plans to invest another $4.3 billion acquiring additional offshore assets with a projected total output of 250,000 bopd in the short to medium term.

Beyond oil, the Aiteo Group has investments in mining, agriculture, infrastructure development, electricity generation and distribution, with a fast-growing retail distribution network. It is focused on serving the needs of communities across the continent by leveraging a unique combination of a strategic asset base, technology, innovation, and some of the best technical and business minds across the industries it operates in. The group has been expanding rapidly, to extend its operations to different countries across Africa and beyond with emerging international presence in the DRC, Ghana, Guinea, Liberia, Zambia, Zimbabwe as well as offices in Geneva and Paris.

Peters is passionate about youth empowerment and has donated generously to support football on the African continent. Through Aiteo, he sponsors the Nigerian Football Federation, CAF Awards, Aiteo Cup (the Federation’s foremost tournament in Nigeria) and a football team in his company’s host community. He has also assisted thousands of internally displaced persons in northern Nigeria while supporting clean water sanitation initiatives in Africa, in partnership with Face Africa, improving the lives of over 25,000 people in rural Liberia. Peters addresses social and environmental issues in the agricultural sector through the Joseph Agro Foundation, set up in July 2014 to tackle chronic unemployment and water shortage.

In recognition of his groundbreaking contribution to development, Peters was one of four recipients of the Marquee Award for Global Business Excellence at the Africa-US Leadership Awards in 2014. In the same year, he received the “Leadership CEO of the Year” award. In 2015, Peters was conferred with the Dr. Martin Luther King Jr. Legacy Awards in the “Economic Empowerment” category. And was listed as one of the ‘50 Most Influential Nigerians in 2017’ by BusinessDay. More recently, he has been recognised as the ‘Oil and Gas Man of the Year’ at the prestigious 2018 Guardian Awards.

In a landmark ruling on Friday July 6, 2018, the Federal High Court in Abuja, Nigeria has directed the immediate release of two properties located in the United Kingdom belonging to African Billionaire businessman and CEO of the Aiteo Group, Benedict Peters that had been the subject of an Interim Forfeiture Order obtained by the Economic and Financial Crimes Commission (EFCC) without notice to him. By this decision, the court has upheld his case that the properties wholly belonged to him; were unconnected to the former Petroleum Minister, Mrs Diezani Allison-Madueke and were unjustifiably included in a list of properties the anti-graft agency tried to seize.

In suit no FHC/ABJ/CS/228/2016, Benedict Peters and two of his companies, Rosewood Investment limited and Colinwood limited, filed applications before the Honourable Justice Binta Nyako, seeking the discharge of the forfeiture order that she had made in April and June 2016 affecting their properties. The factual summary of the case put before the court was that he is the exclusive and beneficial owner of the following properties: Flat 5, Parkview, 83-86 Prince Albert Road, London; Flat 58 Harley House, Marylebone Road, London and 270-17 street, Unit #4204, Atlanta, Georgia, USA, that were wrongly included in a list of 19 properties in the order as allegedly belonging to the former minister.

In an application argued on his behalf by Chief Wole Olanipekun, a Senior Advocate of Nigeria (SAN), the court was urged to vacate the orders because EFCC’s premise for alleging that the properties belonged to Allison-Madueke was manifestly unfounded and not supported by any shred of evidence. Relying on the contentions that EFCC acted “upon gross misstatements, concealment and misrepresentation of facts,” sought and obtained ex-parte an interim order of forfeiture of the properties, Chief Olanipekun argued that “that the mandatory condition precedent to the grant of the interim forfeiture order was not complied with and due process of law was not followed in obtaining the interim order of forfeiture”. For the applicants, it was further asserted that concealment of accurate, relevant information from the judge when the order was made was fatal to EFCC’s case. The applications were based also on a number of significant legal arguments demonstrating the unsustainability of the order.

In her judgement, the Honourable Justice Nyako referred to a decision of the High Court of the Federal Capital Territory (FCT) handed down by Justice Musa in which Peters was a Defendant and declared that “…a subsisting judgement of a Court of coordinate jurisdiction has found and held inter alia that the property listed as Flat 58 Harley House, Marylebone Road, London, and the property listed as Flat 5, Parkview, 83-86 Prince Albert Road, St John’s Wood, London have been subject of the litigation in the suit before the High Court of the FCT, where a judgement of the Court dated 5th December 2017 was made which orders have declared that, these said properties amongst others having being legitimately acquired by the Defendant, they cannot be forfeited to the government under any circumstances.”

Justice Nyako accordingly directed that “the order of interim forfeiture that was made in this case cannot override or supersede an order of final judgement of a court of coordinate jurisdiction.” The learned judge then ordered that in that event, those properties could not continue to be restrained by the order EFCC had obtained and consequently directed the immediate release of the London properties.

However, with regard to the property in the US, the judge took the view that the property would remain affected by the order until further evidence seemingly in the same mould as that produced to the FCT High Court was placed before the court. The US property was not dealt with in the FCT case.

This latest court ruling follows other judgements vindicating Mr Peters from the various allegations that have been very publicly aired by EFCC. On December 5, 2017, the High Court sitting in the Federal Capital Territory declared that earnings and assets accruing to him were acquired legally through legitimate sources. Also, on March 21, 2018, an FCT High Court voided EFCC’s unilateral declaration of him as ‘Wanted,’ describing it as ultra vires, unconstitutional and a flagrant violation of his Fundamental rights. On 7 December 2017, another FCT High Court, in a suit brought against him, declared that a donation of $60m he made to a political party was a legitimate donation and did not violate any provisions of the laws of Nigeria.

The Aiteo group was declared Indigenous Oil and Gas Company of the Year at the Nigerian Oil and Gas (NOG) Awards, on July 4, 2018 at the International Conference Centre(ICC), Abuja. The gala rounds off the Nigeria Oil and Gas Conference and Exhibitions, holding from July 2 to July 5, 2018.

Organised by London-based CWC Group and now in its 18th edition, the NOG is Nigeria’s most prestigious annual oil and gas industry event which draws key players across the Nigerian Energy sector. It is a viable platform for networking, sharing ideas, and exploring new opportunities and innovations in the industry. This year, hundreds of industry professionals were gathered from both the public and private sectors. Dignitaries at the conference included the Secretary-General of OPEC; Dr Sanusi Barkindo, Nigeria’s Honourable Minister of State for Petroleum Resources; Dr Ibe Kachikwu, Group Managing Director of the Nigerian National Petroleum Corporation, Dr Maikantu Baru, and Chief Executives of major oil and gas companies operating in Nigeria.

https://iso.keq.mybluehost.me/cnbc-africa-receives-award-for-best-business-television/

Responding to the award, Aiteo’s CEO and Executive Vice Chairman, Benedict Peters, attributes the company’s emergence as the indigenous oil and gas company of the year to the depth of its human resources, and sustainable investments in the industry, and the Nigerian economy.

“We remain committed to our vision of shaping the future of sustainable energy in Nigeria and beyond, strategically deploying resources and technologies that lead to sustained economic development and value for all stakeholders. This honour from the NOG is fulfilling, particularly coming from our peers and a reputable industry platform. We dedicate this award to the highly committed, talented and industrious people working at Aiteo and making things possible on a daily basis.” Peters added.

In the CSR arena, Aiteo gives back to the local communities in which it operates through grants and donations, seed capital and philanthropy. It has also supported several social investment projects, including special focus on supporting the study of Engineering in host communities and sports.

In sports, Aiteo has become the foremost financier of football in the country after a string of contributions to the Nigerian Football Federation (NFF) and the Super Eagles. To support local football, Aiteo took over the sponsorship of the Federation Cup, Nigeria’s oldest football tournament, now renamed Aiteo Cup. On the continental stage, Aiteo partnered with the Confederation of African Football(CAF) to sponsor the African Football Awards in January this year.

Aiteo Group , the Official Optimum Partner of the Nigeria Football Federation (NFF), last Saturday premiered to industry applause, an official theme song to mentally boost the Super Eagles of Nigeria to go for glory at the Russia 2018 World Cup. This is also as they pledged to donate $50,000 to the team ‘for every unreturned goal’ scored at the Mundial.

Download the song: https://goo.gl/b7yktq

The rousing theme song titled, ‘Dem Go Hear Am, meaning “Go Show Them” was put together by Nigeria’s Hip-Hop/Afrobeat luminaries; Olamide and Phyno. The Single, has been well received by Nigeria’s teeming football and music fans, and is currently enjoying massive airplay with over 1,000,000 downloads recorded across assorted media channels. The hit track had also garnered 7.5 million social media impressions barely 24 hours after release.

According to Benedict Peters, the Executive Vice Chairman of Aiteo Global Group, the Group’s sponsorship of the theme song is yet another demonstration of its commitment to promoting football in Nigeria as a means of uniting the people.

“Football is a phenomenon in Nigeria. You can see and feel its power on every street. It galvanises unity amongst our people, irrespective of ethnic or class differences. As the World Cup kicks off, we solidly throw our weight behind our national team and its ever-effervescent supporters spread across the globe. We look forward to great football moments that will become historic as the Super Eagles play to covet the World Cup trophy,” he said.

Also speaking at the launch of the theme song, President of Nigeria’s Football Federation, Amaju Pinnick, extolled Aiteo for its unflinching support for football development in Nigeria. “Aiteo has been magnanimous, not just to the Super Eagles but in their contributions towards the revitalisation of football in Nigeria and Africa. Our partnership has returned impressive results; we are able to pay our coaches on time and keep our players well motivated. We are glad that Aiteo continues to exceed our expectations always. They are indeed deserving of commendations.”

Aiteo signed a N2.5 billion (about USD 7 million) sponsorship agreement with NFF in May 2017, to cater for the salaries of all national team coaches for a period of five years.

At a star-studded listening party for the theme song which held in Lagos on Saturday June 9, 2018, Aiteo Group, also announced a $50,000 bonus for every unreturned goal scored by the Super Eagles, at the Mundial.

NIGERIAN billionaire and the founder of Aiteo Group, Benedict Peters has denied sponsoring activities of the political movement or organization dubbed ‘Third Force’ or any socio-political partisan association or political party in Nigeria or anywhere else in the world.

Labelling the allegation as ‘fake news’, Benedict Peters in his rebuttal he personally signed added that the report was malicious, damaging, vile and callous. He further urged the general public as well as well meaning Nigerians; home and abroad; to disregard the tweet and its contents.

“My message to the COWARDS who have, again, sought to use cheap, fabricated publicity and dirty media propaganda to cause me embarrassment, is that no assemblage of hatchet jobs/men or media manipulation can shake my unwavering stand and belief in the fortunes of the Nigerian economy and the success of the “Nigerian Project”. Aiteo as a business endeavor has come to stay and will grow bigger in the years to come”, he said.

The statement reads, ” my attention has been drawn to a tweet in which I was mentioned as the major financier to a political movement or organization, presumably not even in existence, called the “Third Force”. While I have received calls and messages advising me to ignore the tweet and regard its publication as the handiwork of detractors, the delicate nature of the tweet – having taken into consideration my travails in recent times, fueled largely by the adverse effects of incomprehensible media falsehood – require that I immediately, authorize the release of a rebuttal, given the malicious, damaging effect the unprofessional tweet is capable of creating.

“For the record, I wish to state, categorically and unequivocally, that I am not a financier of the said organisation or any socio-political partisan association or political party in Nigeria or anywhere else in the world. As an International businessman of repute, I have deliberately kept stayed away from politics preferring, instead, to focus and give my all to the development of my business interests across the African continent. Corporate Social Responsibility contributions has seen the Aiteo Group, which I lead, provide investment support in Medicine and Medical Research dedicated to seeking cures for several ailments which affect the African continent as well as investment in Sport and Sport as a panacea for the development of Africa’s teeming youth population. The latter has been particularly evident in the Sport of football where we have major relationships with the Nigerian Football Federation and Confederation of African Football (CAF).

“This is even as we continue to regularly provide financial support and investments to encourage building the “Nigerian Dream” through multi-dimensional and multifaceted socio economic interventions. Neither I, my immediate family or companies in which I have interests would embark on the sponsorship of a movement which is unknown to us. This would be crass, irresponsible and inconsistent with the commercial prudence that a businessman of my accomplishment would consider. To, therefore, name me as a financier of such a venture is not only vile and callous, it is insensitive and inconsiderate. It is a sad reminder of the length that some people, manipulating the malleable, depraved and downright dishonest elements of the media, can go (for reasons best known to them) in their despicable and contemptible attempts to continue to pitch me against the government of the day in Nigeria!

“Apart from seeking to impugn my integrity as the publication has done, the authors appear to premise the absurdity of their fabrication on my very well publicized relationship with former President Chief Olusegun Obasanjo, GCFR. I confirm that I know the former President very well. He is like a father to me. He was a friend of my father, the late Chief F.B Peters and has a relationship with my family that dates back over 30 years. In the publishers’ indecent haste to malign the former president and I, amongst others, they demonstrated a shameful shallowness that paid no heed to the very personal nature of our relationship.

“For the avoidance of any doubt whatsoever, I also confirm, categorically, that the former President has, on no occasion, discussed or mentioned any such plan or intention to me. This situation very pointedly affirms the irrationality and farcicality of the allegations as a whole.

“As unconvincing and implausible as these allegations are, I am constrained to take steps to address these unbridled excesses as a means of protecting my family, my business and I from these unwarranted personal attacks. Accordingly, I have instructed my lawyers to immediately take steps to obtain a retraction, in the absence of which they are to take all steps available to provide me with protection, remedy and relief”, its continued.
