ALGON also alleged that the resolution was another step by the Seyi Makinde led government in its serial anarchism to impose dictatorship and culture of violence in the state since the case started over a year ago.

It will be recalled that the appellate court had earlier upheld the dissolution of the council chairmen elected during the administration of late former governor Abiola Ajimobi.

Meanwhile, Oyo State House of Assembly had after the judgement passed a resolution directing the embattled council gaffers to surrender all government’s properties in their custody.

But, ALGON in a statement signed by its Chairman, Prince Abass Aleshinloye noted that the judgement had nothing to do with the elections or legalize the unlawful removal by Governor Makinde.

Aleshinloye, in the statement, explained that the court only said that the perpetual injunction /judgement earlier procured by ALGON after the council election on May 6th, 2019 was speculative, hence it allowed the appeal of the state to challenge the judgement and not “the May 2018 election and mandate which were never speculative”.

The statement reads, “It has come to the notice of ALGON, Oyo State, that Oyo State House of Assembly passed a resolution recently directing all democratically elected Chairmen and Councilors in the state to hand over all properties of Oyo State Government in their legitimate care.

“This ridiculous resolution was passed purportedly acting on the July 15, 2020 Judgement of the Court of Appeal, Ibadan Division in a Suit CA/IB/300 BASHORORUN MAJEED AJUWON & ORS. V. GOVERNOR OF OYO STATE & ORS.

“ALGON considers the mischievous Resolution as a product of dullards instinct, legislative rascality and a deliberate misinterpretation of a simple judgment written in simple English language, as another step by the government in its serial anarchism to impose dictatorship and culture of violence in the state since the case started over a year ago.

“Appeal Court never upheld the illegal dissolution of democratically elected local government by the State Governor.

“It only allowed the Appeal by the State Government to challenge the High Court judgement we procured ever before Governor Makinde became governor and not our mandate because it was never a subject of appeal in the first instance.

“In anyway, Appeal Court couldn’t have run contrary to the Supreme Court precedent judgement which clearly declared as illegal, null and void dissolution of elected local government by any governor or state assembly in Nigeria (as reaffirmed in Governor Fayemi & Ors V. Olubunmo & 13 Others)

“ALGON sincerely appreciate the support and understanding of all discerning citizens as we proceed to the Supreme Court for final adjudication”.

The association, however enjoined all elected chairmen councilors, the media and citizens to ignore the repugnant and contemptuous resolution and never join the assembly in its self imposed parliamentary confusion sauced with lies.

Contained in a letter written to the Counsel to the State Government, Mr Akin Onigbinde SAN by ALGON through its lawyer, Kunle Sobaloju Esq , the sacked elected chairmen said the suggestion is a disservice to the people of their local government and Oyo State to collect financial compensation in lieu of their constitutionally guaranteed tenure.

The Association also expressed appreciation to the government for recognizing and acknowledging their mandate as the democratically elected officials of the 33 Local Council and 35 local development areas respectively by offering to pay them their salaries.

“We refer to your letter dated 20th February, 2020 and have brought the contents of the said letter to the notice of our client which they have considered, and by this letter, we wish to communicate their response to you.

The letter reads, “We have our clients’ instruction to express their appreciation to his Excellency for recognizing and acknowledging our clients’ mandate as the democratically elected Chairmen and Councilors of the 33 Local Government Councils and 35 LCDAs in Oyo State by offering to pay them their salaries and allowances due.

“However, our clients consider it a disservice to the people of their respective Local Government Areas and the entire people of Oyo State to collect financial compensation as proposed by you in lieu of their constitutionally guaranteed election tenure.

“Our Clients are equally of the view that accepting financial compensation by way of your calculated salary and severance allowance would amount to aiding the breach of the constitution and may also lead to violation of anti-corruption laws by collecting salaries and allowances for a futuristic job tenure yet to be lived out.

“We therefore have our clients’ instruction to inform you that the financial pay off proposed is unacceptable to them.

“We appreciate your efforts towards the amicable settlement of issues between the parties and convey our professional regards of the highest esteem”, the letter concluded.

The association, while declaring support for the security outfit also appealed to the  governors to subject its operations to democratic control, management of communities and local government authorities as elected representatives of the grassroots for Amotekun not to be abused and misused.

Oyo ALGON  through its Chairman, Prince Ayodeji Abass Aleshinloye stated this at the New Year get together and review of year 2019 activities held at ALGON house, Ibadan, the state capital.

Prince Aleshinloye further disclosed that the association  will  set up a technical committee to study the situation and make recommendations to the governors on it.

“Let me state here that ALGON Oyo State supports Amotekun as we have been doing to create and support any move to address meaningfully the security of life and property as this is the fundamental objective and duty of government at all levels because without security there cannot be governance or development.

“We however wish to appeal to South west governors to subject the operation of Amotekun to democratic control and management of communities and local government authorities as elected representatives of the grassroots for Amotekun not to be abused and misused”, Prince Alesinloye observed.

Reacting to the recent appointment of Caretaker Chairmen in the state , the ALGON boss  insisted that the continuous disregard of the Supreme Court judgement and High Court judgement that forbid dissolution of democratically elected Local Government functionaries shows clearly a flagrant disobedience and abuse of rule of law by the Seyi Makinde – led government.

Alesinloye, however dared Governor Makinde to produce the ‘Court Order’ he repeatedly claimed restrained the conduct of local government election organized during the tenure of former Governor Abiola Ajimobi.

“In his defense, the State Government said the Local Government election that was conducted by the last dispensation was illegal because it contravened court order. The government run by Engr. Seyi Makinde has been asked since then to produce and give evidence of the so-called “Court Order” they repeatedly claimed restrained the conduct of local government election organized during the tenure of Senator Abiola Ajimobi, but all this was to no avail. The order only exists in their imagination.

“As if were not enough, the Governor in his usual characteristics, displayed yet another contempt to highest court of the land with the swearing-in of the outlawed caretaker committee to forcefully take over our seats that were not vacant by law.

“We are equally aware that recently, the Honourable Attorney General of the Federation has issued an advisory directive to the Attorneys General of all the 36 states including Oyo state, requesting they all comply with the decision of the Supreme court outlawing illegal dissolution of Local Councils and which set aside caretaker appointments over local councils.

“The HAGF by his letter demanded compliance with the Supreme court by a restoration of democratically elected Council Chairmen and Councillors in all councils in the states.

“Uptill now Governor Makinde and his government have continued to act illegally and contrary to democratic norms. We reiterate that we shall not fail to continue to fight this illegality prone, unjust and deceptive administration until Governor Makinde submits to, and obeys our constitution, court judgments and the rule of law, the continuing despise of which is an impeachable offence against him”, prince Aleshinloye concluded

ALGON also urged Governor Makinde  to obey the subsisting judgement of the Oyo State High Court and the Supreme Court judgement which prohibit the State Governors from dissolving democratically elected Chairmen and reverse his order of dissolution of local government.

“No doubt, battle must be fought and won but the winner must also be magnanimous in victory. In the spirit of sportsmanship, your Excellency must see your victory as victory for the people of Oyo State and not to a section of people, based on political, religious or tribal affiliations, as a father to all.

“Your Excellency must be ready to accept constructive criticism as no government can be long secure without a formidable opposition and guard against the impostures of pretended patriotism and loyalists.

“Without the supremacy of rule of law, which your Excellency is one of the beneficiaries, our Society will be worst for it, as the rule of men will reign supreme. It will not therefore be out of place, to right the wrong of the past by your administration, to obeying the subsisting judgement of the Oyo State High Court and the Supreme Court judgement which prohibit the State Governors from dissolving democratically elected Chairmen and reverse your order of dissolution of local government.

“We wish your Excellency a successful tenure of office as we pray for the divine wisdom for you to piloting the affairs of our pace setter state”, the statement concluded.
